Acceptance of Terms

When you visit, browse, or otherwise use any service offered by superout Store, you confirm that you have read, understood, and agreed to be bound by these Terms of Service together with all federal, state, and local laws and regulations that apply to you. Should you disagree with any portion of these Terms, you may not access or use any superout Store offering. Anyone accepting these Terms on behalf of a company or other organization confirms that they hold the authority to legally bind that entity to these Terms.

Use of the Website

You agree to access and use superout Store's services solely for lawful, personal, non-commercial purposes, unless superout Store has granted you permission in writing to do otherwise. You must not:

• Submit fraudulent, excessive, or malicious orders, including orders placed without any genuine intention to receive the goods
• Resell superout Store products for commercial profit without obtaining our express written consent

Product Information and Pricing

superout Store works diligently to keep product descriptions, prices, specifications, and availability details accurate and current. If product information, pricing, or availability contains an error, we may correct that error and cancel any order placed on the basis of the incorrect information, at no cost to you. For goods that naturally vary (such as handmade items or products made from natural materials), minor differences in dimensions, weight, or appearance from the listed specifications may occur. Product details and warnings are supplied for reference only; superout Store cannot guarantee that products are free from cross-contamination during processing or packaging. Availability may differ depending on your delivery zone, pickup location, and chosen time slot.

Orders and Payment

Every order depends on product availability and acceptance by superout Store. We may decline or cancel any order at our sole discretion, including orders that appear fraudulent, breach these Terms, or cannot be fulfilled because of stock shortages. Unless we agree otherwise in writing, payment must be received in full before an order is dispatched or collected. Minimum order values and delivery fees may apply depending on your selected delivery zone and time slot. For age-restricted products (including alcohol, tobacco, and vaping products where legally permitted), you must meet the legal age requirement for purchasing such items in your jurisdiction, and valid government-issued identification will be required at delivery or pickup. If an item in your order is unavailable, we will notify you before dispatch and may offer a suitable substitute or refund the unavailable item, unless you have opted out of substitutions at checkout.

Intellectual Property

All content appearing on superout Store's platforms — including text, images, logos, software, private label product packaging, and the "superout Store" name and branding — belongs exclusively to superout Store and is safeguarded by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any superout Store content without our express written permission. User-generated content (including product reviews, photos, and comments) that you submit to our platforms may be used by superout Store for marketing, promotional, or operational purposes, in accordance with our Privacy Policy.

User Responsibilities

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must notify superout Store immediately if your account is used without authorization or if any other security breach occurs. You are also responsible for supplying accurate, current contact, delivery, and payment information when placing orders, and for ensuring that any special instructions, eligibility requirements, or product-specific conditions you submit are truthful and complete. If you place an order on behalf of a third party, you alone are responsible for ensuring that third party satisfies all legal eligibility requirements for the purchased products, including age restrictions for restricted goods.

Limitation of Liability

Our total aggregate liability to you for any claim arising from a single transaction shall not exceed the total amount you paid for the products or services in question. superout Store is not liable for failures or delays in service resulting from circumstances outside our reasonable control, including but not limited to supply chain disruptions, severe weather, public health emergencies, or third-party carrier delays.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of superout Store's services shall first be submitted to superout Store's customer support team for informal resolution. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered by a recognized arbitration provider in New York, NY, in accordance with the provider's commercial arbitration rules. The award of the arbitrator shall be final and binding on the parties, and may be entered in any court of competent jurisdiction.

Changes to These Terms

superout Store reserves the right to update, modify, or replace any part of these Terms at any time at our sole discretion. If we make material changes to these Terms, we will provide at least 30 days' advance notice via email to the address associated with your account, or via a prominent notice on our website. Your continued use of our services after the effective date of any revised Terms constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using superout Store's services prior to the effective date of the changes.
